Terms and Conditions for ACTIVE 24 Sp. z o. o Services
§ 1.
These Regulations of rendering Internet services defines Terms and Conditions of Internet services by ACTIVE 24 Sp. z o.o. ( www.ACTIVE24.pl and www.Domeny.org service owner), with its head office in Warsaw, Al. Niepodległości 69 , hereinafter referred to as Service Provider on terms defined in these Regulations.
- The Regulations define rules of domain registration and also account creating and administrating.
- The Regulations should be read carefully before making any commitment to any promotion. Participating in any promotion means that the Subscriber is acquainted with the Terms and Conditions and accepts all its provisions.
§ 2.
- Regulations – following document governs the terms of cooperation between Service provider and Subscriber.
- Service Provider - ACTIVE 24 Sp. z o.o.
- Applicant - an entity who wants to enter into an agreement containing domain registration or other services.
- Subscriber - an entity who entered into an agreement including domain registration or other services.
- Service - an order made by the applicant after accepting the regulations.
- Pro-forma invoice - document issued by the Provider before the payment, forming grounds for the payment.
- Payment - paid in advance by the Subscriber for the Services All services are billed and to be paid in advance, being due on or before the start of service or beginning of renewal period.
- Domain - unique sequence of alphanumeric characters containing the name and the extension.
§ 3.
- Order by:
- filling a form on: www.ACTIVE24.pl, www.Domeny.org,
- sending an e-mail regarding the selected service,
- sending a fax regarding the selected service,
- ordering by phone is not tantamount to the beginning of domain registration process. Confirmation of coming into possession of domain is entry in the WHOIS database which has to be made after registration.
NOTE! In case of any changes or order resignation The Customer is obliged to enter correct data via administrative panel C-panel. Services are registered automatically and money transfers descriptions will not be taken into consideration!
- Domain or server account activation or redirection is come within 48 hours after entering the payment in account books or after payment confirmation.
- Subscriber is allowed to:
- use the account freely during the activation period within the confines of its technical specifications
(different depending on server type), excluding placing of the prohibited by law and pornographic content.
- terminate the agreement anytime during the activation period and demand removing his service name and address from the reference list.
- After paying the payment for the domain registration, Subscriber becomes the rightful owner of the domain and can manage it freely.
- Server bought with the domain is its integral part and cannot work separately.
- Subscriber is obliged to enter correct data, without violating the third parties laws while registering the domain and using accounts and to accept and obey the regulations. Use of incorrect data and violating of the regulations allow the Provider to discontinue providing of the service.
- When there is a necessity to get an Authinfo, AuthCode for domains – The Subscriber should ask for it at least 14 days before the expiration date to be 100% sure, The Subscriber will be given the authinfo at least 24 h before the expiration date.
- Provider is obligated to send by e-mail, within 30 days before the expiration date, a new pro-forma invoice for the following period. We can not guarantee that the subscriber receives and reads the e-mail. Therefore, the responsibility of The Subscriber is also to mind the payment terms himself. After the payment came in, expiration date is prolonged to the following subscription period. In case there is no payment up to the expiration date, Provider will not continue providing of the service. If the payment came in after the expiration date the Provider will make an effort to extend the expiration date. If extension of the expiration date or repeated registration is not possible, Provider will not continue making an effort and the payment is lost to the Provider's advantage.
- Provider is obligated to provide the service continuously during the subscribe's period.
- Provider is also obligated to keep the price of the registration and the extension of the expiration date unchanged.
§ 4.
- By activating the Service, Subscriber consents to processing of the personal details by www.ACTIVE24.pl i www.Domeny.org and ACTIVE 24 Sp. z o.o., according to 23 par. 1 item.1 and par. 2 Act from 29.08.1997 concerning Protection of personal details (Dz U. Nr 133 poz. 883).
- Provider is obligated to keep the Subscriber's personal details confidential and not to make it available to the third parties. The Provider has got the right to make the Subscriber’s basic personal details available for the WHOIS service. For organizational units as well as physical entities there will be full information - address, e-mail and phone number. The exception is a polish domain's .pl registration – then data of the physical entities are not available for the WHOIS.
§ 5.
- The Provider writes out the invoice with the date similar to this on the proof of payment as soon as the proof of payment is delivered to the Provider.
- Payment for the service (a domain registration and a hosting) is paid for the whole period and it is not returnable even if the Subscriber resigns from the service.
- If the Provider is unable to provide the service that has been paid for, the Subscriber has got the right to order one of the other services or to a refund.
§ 6.
- In case the payment is not paid for the following period, the agreement expires with the last day of the subscribe period.
- The Provider has got the right to discontinue providing the service if the Subscriber breaks the rules of the regulations, law or Netiquette. If those cases appear the Provider is not obligated to return the payment for the period in which the service is not being provided.
§ 7.
- The Provider takes full responsibility for the losses incurred by the Subscriber due to improper execution or through the lack of execution of the service through the Provider's fault.
- The Provider does not take responsibility for the losses caused by:
- improper use of the accounts,
- entering incorrect information during registration,
- telecommunication links breakdown,
- improper actions of third party companies that have influence on the services offered in Active24.pl,
- access to the Subscriber account by the third parties, no matter how it happened (i.e. providing third parties with password, breaking the password, etc.)
- discontinuing providing the service through the Subscriber's fault.
- The Provider reserves the right to:
- temporarily disconnect the services due to maintenance or upgrade of the servers
- remove an account if it is used against the law or the actions performed by the Customer cause disruption in server's work and stability
- lock the account if the transfer limitations have been reached and the additional transfer haven’t been paid for
- to make the customer's name and www service available for the reference list, as long as it is in the customer’s will.
- Any complaints should be made on paper and sent using the registered letter
- The Provider is obligated to settle the complaint within 14 days of its receipt.
§ 8.
- By accepting ACTIVE 24 Regulations you also accept NASK Regulations from 18th of December 2006 that can be found at: www.dns.pl.
- In case of changes in Regulations of ACTIVE 24, NASK or other domain Registrars – the acceptance of these changes takes place during the registration of new services or during the extension of existing services.
- Since 01.09.2007. new Regulations of the OPTION in NASK have applied. The previous Regulations expired in 31.08.2007 r. New Regulations of the OPTION is available at:www.dns.pl
- With reference to the registration of european domains .eu (www.eurid.eu), global domains .com, .net, .org, .info, .biz (www.icann.org) and other foreign domains (such as .tv, .cc) the appropriate rules arising from particular domain Registrar Regulations apply.
§ 9.
- These Regulations enter into force on 1st of August 2004.
- In cases not regulated by this document, the provisions of Civil Code and appropriate laws shall apply.
